Defining ERISA Relief

ERISA covers participants in or beneficiaries of employee benefits plans governed by ERISA—typically employees, former employees, and members of unions or employee organizations who are eligible to receive benefits. Under ERISA, plan administrators are personally liable for COBRA group health continuation notification violations, failure to timely deliver ERISA plan documents to plan participants, and for breaches of fiduciary duty by ERISA plan fiduciaries.
